The Internet and Mobile Association of India (IAMAI), in collaboration with the Federation of Indian Fantasy Sports (FIFS) and the E-Gaming Federation (EGF) is all set to organise the first edition of the nation’s largest gaming conference, the Indian Gaming Convention (IGC), on December 5, 2023, at the Taj Palace, New Delhi. Shri Rajeev Chandrasekhar, Minister of State for Skill Development and Entrepreneurship, and Electronics and Information Technology, Government of India, will deliver the keynote address at the valedictory session.

Leading policymakers, regulators, gaming industry captains, marketers, game developers and service providers will converge on one platform to address the IGC, which is expected to draw more than 700 delegates, including senior professionals of the online gaming ecosystem of the country.

In its BSE filimg, Nazara Technologies said, "The Board of Directors of Nazara Technologies Limited has considered and approved issuance of the 57,42,296 fully paid up equity shares of the Company having face value of Rs. 4/- each ("Equity Shares”) in addition to the already approved issuance of up to 14,00,560 fully paid up Equity Shares by the Board of Directors at its meeting held on September 4, 2023, both together aggregating to an amount not exceeding Rs. 510 crores."

Outlines that the policymakers’ concerns around online gaming are unsupported by user time-spend and money-spend data.

Esya Centre, a leading tech & policy think tank, released a report titled “New-Age Digital Consumption: A Survey of Social Media, OTT Content and Online Gaming" that examines the consumption and engagement patterns of users across three digital entertainment avenues: Social Media, OTT and Online Gaming including real money gaming, e-sports and casual gaming. An academic version of this report is published in an IIM-A working paper co-authored by Dr. Rajat Sharma, Associate Professor, IIM-Ahmedabad and Dr. Vikash Gautam, Adjunct Fellow, Esya Centre. The paper outlines that policy concerns around unwanted user actions, especially in online gaming, are not supported by user time-spend or money-spend data.

The report delves into data gathered through a comprehensive survey conducted across ten major cities: Delhi NCR, Bengaluru, Chennai, Mumbai, Kolkata, Patna, Mysuru, Lucknow, Jaipur, and Bhopal. This survey involved 2,000 respondents and was further supported by in-app data from over 20.6 lakh users, spanning across 143 mobile applications.

Below are the key findings of the report:
  • Behavioural lock-in: Daily engagement in terms of time spent is the highest for social media at 194 minutes a day. This number for OTT and Online Gaming stands at 44 minutes and 46 minutes, respectively.
  • Time and use pattern: A median user spends less than INR 100 a month and less than an hour a day on online gaming. The corresponding number is INR 200-400 for OTT.
  • Price Sensitivity: Users say that a 30% increase in participation fee for online games may lead to a 71% dip in engagement, indicating a high price sensitivity. This number would only be 17% for OTT.
  • User Motivation: While OTT is considered a significant stress buster, 28% of Digital Nagriks consider online gaming important for their employment prospects.
  • 3User Stickiness: While all users are active on Social Media once a month, the corresponding number for OTT and Online Gaming is 60% and 40% respectively. 89% users are active every day on Social Media while only 22% and 12% are active on OTT and Online Gaming respectively.
Commenting on the key insights from the report, Amjad Ali Khan, Director at the Esya Centre said “There is a lack of research examining both policy and user adoption trends in key digital markets. We believe that the findings of the report are very relevant, especially at a time when the Government is in the process of formulating user-centric policies for the digital industries. We hope that the insights from the report will help inform a forward-looking policy stance that focuses on user protection over paternalistic interventions and blanket bans.”

Further, calling India’s regulatory landscape more progressive than its peers, Mr. Rajat Sharma, Associate Professor, Indian Institute of Management Ahmedabad (IIM-A) said that “India is moving from a command-and-control model of regulatory oversight to a light touch model for new industries. While technology is dynamic, consumption patterns are more predictable. Therefore, building a profile of a Digital Nagrik and their consumption patterns can form the crux to an agile policy ecosystem for the three sectors. An attempt our report aims to make.”

The report comes after the GST Council’s meeting that changed the GST levied on the online gaming industry from 18% on Gross Gaming revenue (GGR) to 28% on deposits, leading to a 350%-400% jump in the industry’s GST outgo. User addiction and loss of money were cited as some key reasons behind this steep hike. Interestingly, MeitY earlier this year published rules to regulate the industry. The rules were hailed as balanced, and laser focused on user safety. The ministry is soon expected to notify Self-Regulatory Bodies for the regulatory oversight of the industry.

According to the report, user safety, grievance redressal and cumbersome KYC requirements are the three key points of concern for users across Social Media and Online Gaming. Users of OTT however describe their experience as smooth on almost all accounts - which is a testimony to the standardization of quality of service in an otherwise heterogeneous digital entertainment industry.

A first-of-its-kind study on online gamers in India has revealed the growing trend of gaming emerging as a career option in India and not just being limited to a means of entertainment. Based on the study, 83% of the respondents consider gaming as either a primary or secondary source of income, highlighting the paradigm shift towards gaming being a viable option that can be pursued professionally. Out of this, 39% consider gaming as a primary source and 44% as a secondary source of income. The study also highlights how gamers have been able to garner better earnings with improved skill sets, and practicing gaming has also encouraged them to take it up as a profession. This new gaming segment, Paid Competitive gaming (PCG), is poised to be one of the fastest-growing segments and is set to reach $16B by 2024, according to a recent report by Newzoo and MPL.

Another key insight revealed by the study shows how the popular online games played by Indians range across Puzzle, board games and adventure sports as the top choices across demographics and levels of engagement. Success in online gaming also demands a set of essential skills like Analytical skills (97%), concentration (87%), and creativity (69%).

Family and social support prove to be diverse landscapes within the gaming community. While 71% of respondents initially encountered low family support, 17% experienced moderate backing, and only 12% experienced familial encouragement when venturing into online gaming. The study also highlighted how family and social support increases as gamers not only begin to earn from gaming but also display focus and commitment to continue to hone their skills.

Bringing out insights on the earning potential of professional gamers, the study shows how they rely on a diverse array of income sources ranging from Gamer contracts (51%), sponsorships (14%), streaming (5%), content creation (9%), and coaching (21%).

On the impact of regulations on the online gaming landscape, the study showcases concerns raised by the gamers highlighting how 89% feel high tax through GST & TDS has increased their cost of playing and may force them to seek a remedy through alternate platforms if GST is increased further. The criminalisation of players by state governments & absence of uniform regulations has also been reported as a key concern, with 62% of the gamers being affected by the approach taken by many state governments like Tamil Nadu, Telangana, Andhra Pradesh, Odisha and Assam. The study further delves into the social aspects and the resultant impact on online gamers. Lack of clarity on games of skill and games of chance has led to misconceptions and social stigma, especially for those who play professionally. 71% have reported low family support as a result of this.

MeitY rules end the legislative ambiguity for online gaming - reinforce Central Regulation for the sector

The Ministry of Electronics and Information Technology (MeitY) last week notified the IT Rules to regulate the online gaming sector in India. With the notification of these Rules, it is now absolutely clear that online gaming is within the exclusive domain of the Central Government’s regulatory purview and states would only legislate on matters pertaining to betting and gambling. This marks a milestone for the online gaming industry that was grappling with challenges in the absence of a nodal ministry and a national regulatory framework. MeitY was appointed as the nodal ministry for Online Gaming in December 2022 by the way of amendment to the “Allocation of Business Rules”.

Gopal Jain senior advocate, Supreme Court of India said, “The rules give the much awaited legal recognition across the country to the online gaming industry thus laying the foundation for its accelerated growth and reinforcing India’s tech-leadership. Additionally, the rules ensure that there is a clear distinction between online gaming and games which are in the nature of betting, gambling and wagering. The rules were introduced after conducting extensive stakeholder consultation by the MeitY.

With these rules, any attempt by the states to regulate online gaming will defeat the intent of these rules and will not withstand judicial scrutiny and will be against the constitution.”

He further added, “This will also hopefully provide clarity and help address the current conundrum on GST that the industry has been grappling with.

Rajeev Chandrasekhar, Minister of State for Electronics and IT commented “State governments’ regulating online gambling is not required any more after the IT rules for online gaming have been notified.”

Importantly, all States and several central government ministries were consulted before the notification of these Rules. The process started off in May 2022 with the formation of the Inter-ministerial Task Force (IMTF). The task force included government think-tank Niti Aayog's CEO as well as secretaries of home affairs, revenue, industries and internal trade, Ministry of Electronics and Information Technology (MeitY), information and broadcasting and sports. This was followed by an extensive stakeholder consultation with the State Government wherein representatives from 13 states and UTs were present. The final IMTF report was submitted after incorporating inputs from all these representatives, post which MeitY was appointed as the nodal ministry.

For several years, the lack of clarity has led to a conflict between state and central prerogatives and resulted in several court precedents upholding the legitimacy of online skill gaming platforms doing business in India. The industry has also faced legal challenges in States like Tamil Nadu, Telangana, Assam, Orissa, Rajasthan and Madhya Pradesh in the past, and many courts have repeatedly upheld the constitutional protection afforded to online games which are not in the nature of betting, wagering or gambling.
