Apple Lost Legal Battle Against Huawei on Use of Trademark



Apple has lost a legal battle against China's Huawei to block using the 'MatePod' name as its earbuds device. Last year in January, Huawei filed a trademark application at EUIPO (European Union Intellectual Property Office) and UK IPO, for the name ‘MatePod’ with the classification including headsets and earphones.

According to a report in the South China Morning Post, the iPhone maker opposed the Shenzhen-based Huawei`s use of the "MatePod" brand in the earphone category "on the grounds that it was similar to Apple`s own trademarks for the terms Pod, iPod, EarPods and AirPods". However, the Trademark Office of the China National Intellectual Property Administration (CNIPA) found “insufficient evidence” to prove Huawei’s applications infringed upon Apple’s branding.

According to CNIPA, Apple argued that Huawei "maliciously copied" its trademarks, "which could have a negative impact on society".

The Chinese authority, however, did not find Apple`s argument compelling.

The trademark authority said that there was "insufficient evidence" that proved Huawei`s applications to be copies.

As per the report, Huawei has also been granted the MatePod trademark, although, Apple still has the right to file for additional appeals to CNIPA to go back on this decision.

Apple shipped around 72.8 million units of AirPods last year, dominating the market for true wireless headphones with a 31 per cent share, according to Counterpoint Research.

However, the global market for TWS (True Wireless Stereo) hearables saw tepid QoQ growth in Q2 2021. Apple lost considerable share in both sales volume and value despite big price drops on the AirPods.

Huawei Launching Its Android Competitor 'Harmony OS' Today



Chinese smartphone maker Huawei is set to roll out its Google’s Android competitor platform, Harmony OS, today. The operating system was first unveiled after the United States’ trade ban led Google to withdraw Huawei’s Android license last year.

The operating system is set to roll out to the company’s device today, on devices across Asia.

HarmonyOS 1.0 was announced in August 2019, and was first used by Huawei smart TVs for the Chinese market. HarmonyOS 2.0 was then announced in September 2020, and beta versions were available for selected Huawei smartphones from December 2020.

Huawei gadgets have been cut off from updating Google’s Android operating system since August, following a series of U.S. sanctions against the Shenzhen-based company. The ban also cost Huawei access to the U.S. company’s package of smartphone software known as Google Mobile Services, used widely across the industry.

Huawei claimed that HarmonyOS is a microkernel-based, distributed OS that is completely different from Android and iOS. However, it was later revealed that HarmonyOS 1.0 was based on Android 9 Pie, and supported Android Debug Bridge.

Huawei's Global Smartwatch Shipment Rises to Second Place in Q1 2020

Recently, the International Data Corporation (IDC) released the Worldwide Quarterly Wearable Device Tracker report, which showed that global shipments of wearable devices reached 72.6 million units in the first quarter of 2020, with a year-on-year increase of 29.7%.

According to the report, Huawei maintained a high share of the wearable market in the first quarter of 2020, with a year-on-year wearables shipment increase of 62.2%.

In the smartwatch segment, 16.9 million units of smartwatches were shipped in the first quarter of 2020, down 7.1% year on year. Huawei ranked second with 2.6 million units shipped, up 118.5% year on year, making it the only smartwatch brand to grow more than 100%.

The IDC report said that Huawei continued to grow thanks to its strong online presence and close ties with retailers. Besides the Chinese market, Huawei also made successful progress in Europe, Latin America, and other Asian markets.

To Deal China, UK Approaches for New 5G Club of 10 Democracies, including India: Report

The British government has approached the US with the prospect of creating a 5G club of 10 democracies, including India, amid growing security concerns related to Chinese telecom giant Huawei, according to a UK media report.

A so-called “D10” club of democratic partners, including G7 countries – UK, US, Italy, Germany, France, Japan and Canada – plus Australia, South Korea and India will aim to create alternative suppliers of 5G equipment and other technologies to avoid relying on China, ‘The Times' reported.

The move to speed up such a club comes as the UK launched an inquiry into Huawei's involvement in the country's mobile network upgrade in the wake of US sanctions against the company.

“We need new entrants to the market. That was the reason we ended up having to go along with Huawei at the time,” the newspaper quoted a UK government source as saying.

Nokia and Ericsson are the only European suppliers of 5G infrastructure and experts say that they cannot provide 5G kit as quickly or as cheaply as Huawei.

Britain has labelled Huawei a “high-risk” vendor and therefore its involvement in the UK's 5G upgrade comes with a 35 per cent market cap, including a ban on its participation in the sensitive “core” of the network.

The review into Huawei, launched last week by the UK”s National Cyber Security Centre, followed the announcement of US sanctions to block the sale of American chips to the company.

UK security officials fear that the ban will prompt China to use cheaper, less secure technologies, instead of verified US versions.

Officials are, meanwhile, examining proposals to curb the installation of Huawei kit in the 5G network from 2023.

According to the newspaper, increasing the partnership of like-minded democracies forms part of the ongoing reappraisal of the Chinese firm's involvement in the UK.

The US in recent months has increased its action against Huawei, China's first global tech brand and a maker of network equipment and smartphones, preventing it from doing business in the US, as it believes the company known for its technological advancement in 5G is being used by the Chinese leadership to serve their interest.

The Trump administration says Huawei is a security risk, which the company denies, and is trying to persuade European and other allies to shun its technology for the next-generation telecom networks.

China has accused the US of raising phony security concerns to hurt a rising competitor to American tech companies.

US Imposes New Sanction on Huawei to Use American Technology

The US government has imposed new restrictions on Chinese tech giant Huawei's ability to use American technology, stepping up a conflict with Beijing over industry development and security.

Commerce Secretary Wilbur Ross said Friday that Washington wants to prevent Huawei from evading sanctions imposed earlier on its use of American technology to design and produce semiconductors abroad.

“There has been a very highly technical loophole through which Huawei has been able to in effect use US technology," Ross told Fox Business. "We never intended that loophole to be there.”

Huawei Technologies Ltd, China's first global tech brand and a maker of network equipment and smartphones, is at the center of US-Chinese conflict over Beijing's technology ambitions. American officials say Huawei is a security risk, which the company denies. China's government has accused Washington of misusing security warnings to harm a rising competitor to U.S. technology companies.

Under the new rules, foreign semiconductor makers must obtain a US license to ship Huawei-designed semiconductors to the Chinese company that were produced using US technology.

The move “looks like a victory for the people who really want to drive the nail, or what they think will be the nail, in Huawei's coffin,” said Adam Segal, a senior fellow at the Council on Foreign Relations.

China threatened retaliation against US companies.

Chip design and manufacturing equipment used in the world's semiconductor plants is mostly U.S.-made, so the new rule affects foreign producers that sell to Huawei and affiliates including HiSilicon, which makes chips for supercomputers with scientific and military uses. The Commerce Department said foreign foundries would be granted a 120-day grace period for chips already in production.

Last year, the Trump administration barred U.S. firms from using Huawei technology or providing technology to the Chinese firm without government approval, deeming it a national security risk. The Commerce Department exempted a narrow list of products and services and has extended that waiver to reduce the impact on U.S. wireless carriers that use Huawei technology. This week, it added another 90 days.

Huawei responded by removing U.S. components from its core products.

The company reported global sales rose 18 per cent to USD 121 billion last year despite the restrictions, though it said smartphone sales suffered after it was blocked from preinstalling music, maps and other services provided by US-based Google.

The new restrictions are separate from those exemptions, but loopholes have allowed U.S. companies to supply Huawei with chips made outside the US.

The Commerce Department said Friday the new restrictions would “narrowly and strategically" target Huawei's acquisition of semiconductors that it designs built in overseas foundries that use U.S. software and technology.

Kevin Wolf, an attorney at Akin Gump who oversaw export administration at the Commerce Department during the Obama administration, noted the narrow scope of the rules.

"If a foreign foundry makes a chip based on a Huawei design and U.S. equipment is used to make a chip then it's controlled, but if a chip is not made from a Huawei design then it is not controlled,” he said.

Huawei did not immediately respond to a request for comment. But China's official Global Times newspaper threatened countermeasures on Friday. It said Beijing that could include restrictions on U.S. companies including Qualcomm, Cisco and Apple. It also threatened to suspend purchases of Boeing aircraft.

Global Times noted that the new rules would block companies such as TSMC, a Taiwainese chip maker, from providing semiconductors to Huawei.

TSMC said it was “following the U.S. export rule change closely.” The company said the semiconductor supply chain is “extremely complex" and TSMC was working with lawyers to "conduct legal analysis and ensure a comprehensive examination and interpretation of these rules.” TSMC announced plans this week to build a chip plant in Arizona. EMUI 10.1 Improves upon the Seamless AI Life Experience

During the HUAWEI P40 Series Global Launch, Huawei unveiled EMUI 10.1, introducing more capabilities enabled by Huawei's distributed technology to enrich the user experience.

First introduced in EMUI 10, Huawei's distributed technology is the cornerstone of Huawei's all-scenario ecosystem. Hardware capabilities are virtualised and shared among all connected devices, breaking down the barriers between individual products to enable seamless collaboration. Devices such as smartphones and notebooks no longer work in silos, and instead function together in a connected and collaborative manner. With the latest development in Huawei's distributed technology, EMUI 10.1 builds upon the foundation of its predecessor, introducing new features such as HUAWEI MeeTime and more Multi-screen Collaboration capabilities to let users take better advantage of multiple devices at once. Huawei is also working with a range of partners to expand the connected ecosystem, so as to allow more devices to work seamlessly together and benefit consumers in more scenarios.

UI Improvements

Scrolling now reacts to user inputs with a new physics-inspired friction-slide effect. Similar to how objects in motion gradually decelerate as they lose their momentum to friction, the scrolling animations now also slow down before coming to a natural stop. The acceleration model is developed based on human factors research, ensuring that the animations behave just as users would expect.

Swiping inwards from either side and pausing bring out the sidebar. Apps inside the sidebar can be dragged across the screen to initiate Multi-Window. Images, text and even files can be dragged from one app to another. Floating Window allows users to perform basic tasks such as responding to text messages without exiting the active full-screen app, so users can stay focused on their tasks at hand.

Multi-Device Control Panel

Multi-Device Control Panel provides a unified platform that lets users see every connected device in their proximity at a glance. Connecting one device to another is as easy as tapping on the corresponding button on the menu. Available by swiping up from either corner, the panel can be used to turn IoT devices on or off, set up smartphone screen projection, initiate Multi-screen Collaboration and more. The Multi-Device Control Centre also intelligently recommends nearby devices that can be used to improve the current user experience. For instance, when a user is listening to music on HUAWEI Music with a HUAWEI Sound X nearby, Multi-Device Control Panel will suggest switching audio output to the smart speaker to get better sound quality.

HUAWEI MeeTime

EMUI 10.1 introduces HUAWEI MeeTime[1], the world's first all-scenario video calling app. Supporting up to 1080p Full HD video calls between Huawei devices, HUAWEI MeeTime takes full advantage of the integration between Huawei's software and hardware to deliver a high quality video call experience. Brightness enhancements and beautification algorithms are built into HUAWEI MeeTime to optimise video quality in low-light conditions. Optimisations are also made to enable HUAWEI MeeTime to deliver a smooth video call experience even in less optimal network conditions. Users may also share their screen during a call with the other party and simultaneously mark-up the screen to collaborate with each other. Thanks to Huawei's distributed technology, third party cameras such as Drift action camera can be wirelessly connected with a Huawei smartphone running EMUI 10.1 and be used as an external HUAWEI MeeTime camera to bring new experiences to video calls.

Multi-Screen Collaboration

New capabilities have been added to Multi-Screen Collaboration with distributed technology, allowing users to leverage more HUAWEI MateBook peripherals to better use Huawei smartphone applications. After a quick setup process that involves just a simple tap, users can now make or pick up video or audio calls through the Huawei PC. Huawei's distributed technology enables users to use the PC's camera and microphone as though it was connected to the smartphone. Users can also use native PC applications to directly open files or hyperlinks on the smartphone and take advantage of better hardware and the converged app ecosystem for improved productivity.

Huawei Share

Huawei Share on EMUI 10.1 supports high speed file transfer between two Huawei devices. In addition to Huawei smartphones, tablets and PC, Huawei Share now also supports third-party products. For example, renowned European photo printing company Cewe has implemented Huawei Share in their photo printing kiosks, enabling users to easily print their photos wirelessly.

Celia

Huawei's voice assistant Celia is arriving with EMUI 10.1 for international markets. Simply wake up the voice assistant by holding down the power button for one second or saying "Hey Celia". Celia has a range of abilities to help users get things done. The deep integration grants Celia access to the device's hardware and AI, enabling the voice assistant to support object identification, media playback control, text messaging, face-to-face translation, calorie scanning and more. Celia speaks English, French and Spanish at launch, and will be rolling out to the United Kingdom, France, Spain, Mexico, Chile and Columbia in the first phase, with more countries to come in the future.

Cross Device Photo Gallery

With the distributed file system, Gallery now aggregates all media saved across Huawei smartphones and tablets running EMUI 10.1 that are connected to the same Wi-Fi AP network and logged in under the same HUAWEI ID. The search feature covers all aggregated media for users to easily find the photo or video that they are looking for, no matter on which device it is saved.

Availability

Huawei Rolls out Doorstep Repair Service for its Smart Watch Customers in India

Consumers can get Huawei Watches including Huawei GT and Huawei GT2 replaced without any cost during the warranty period for any performance and functional related default.

As per the new policy, customers can also get the spare parts replaced for out of warranty Huawei Watch GT and GT 2 (46mm).

Huawei will now provide pick and drop services for its select smart watches in India.

Huawei is not only appreciated for high quality products but also for the company's excellent after-sales services for its valued customers. Furthering its commitment to provide the most exceptional customer services, Huawei Consumer Business Group India (BGI), announced VIP Customer Services for the newly launched Huawei Watch GT 2 and its predecessor Huawei Watch GT.

Being a wearable device, smart watches are highly prone to damages, like any other hand-held technological devices such as mobile phones and tablets. Considering the same, Huawei Consumer BGI has exclusively rolled out initiatives in India that helps customers enjoy their Huawei smart watch.

Of the many initiatives, Huawei has introduced no cost replacement policy for Huawei Watch GT 2 and GT during the warranty period. Huawei's Announces the Grand Launch of its Next Image Awards; World's Leading Online Mobile Photography Competition

Huawei has also announced the launch of the fourth edition of its legendary Next Image Awards. Huawei's Next Image Awards is one of the world's best online photography awards that is committed to broaden the horizon of visual culture and encourage mobile photography worldwide.

The "NEXT" in NEXT-IMAGE refers to the next generation of photographers using the next generation of tools to create and spread the next generation of visual content - all with new forms of interaction and feedback. The "IMAGE" part of the name refers to both static imagery and new forms of dynamic visual expression.

Huawei has proposed the "NEXT-IMAGE" concept not only to highlight the many years of innovative spirit it has brought to the field of visual expression, but also to create a new word that conveys its insight into what it believes is growing into a new school of photography. In 2019, more than 150 + countries participated and over 520,000 entries were received.

The competition requires the participants to send their best photograph, which will be meticulously judged by the jury members. Under the umbrella of the competition lies six categories, one of which a participant must stick to while submitting his/her entry. The participants have to send their entries and brownie points will be awarded to shots taken through a Huawei phone. Apart from the 3 grand prizes of USD $10,000 each, each of the 6 categories will have its own winners. Fifty runner ups can also win the flagship Huawei P40 Pro smartphone each.

The six categories are as follows -


  1. Near Far - Discovering new places and new experiences thereby using new features of phone camera, for instance tele-photo, super-wide angle or macro-shooting lens.

  2. Good Night - Capturing fun moments in low light.

  3. Hello Life! - Sharing the emotion or the inspiration in everyday experiences.

  4. Faces - Experimenting with identity and the power of portraiture of you yourself, her/him/it or them.

  5. Live Moments - Filming stories in less than 10 minutes (at least 10 seconds, mp4 only).

  6. Storyteller - Sequencing 3 to 9 photos to express the emotion, to record the changes or to find a trend.



The jury consists of eminent photographers such as Steven McCurry and Elizaveta Porodina, along with Li Changzhu, Vice President of Handsets Product Line of Huawei CBG and Andrew Garrihy, Western Europe CMO of Huawei CBG.

"Huawei's Next Image Awards is one of the world's most well-known online photography competitions. Since 2017, more than 150 countries have participated and we have received more than 1 million submissions. We extend the invitation to all photography enthusiasts worldwide to participate in the contest and win exciting prizes of upto USD $10,000. Huawei Claims No.1 Spot in European Patent Office Ranking 2019; Reaffirms its Leadership in Tech-innovation

Patents help establishing a strong market position, thereby reducing competition for a brand. Furthermore, patent portfolios are also demonstrative of high level of technological capability, specialization and expertise of a company. In that light, in a yet another feat, Huawei Technologies claims the top spot in the European Patent Office (EPO) ranking for 2019. In a recent report published by the EPO, Huawei has been ranked the top telecom company in Europe, with a maximum number of patents in 2019. The company ranking reflects the growing importance of digital technologies and Huawei's leadership in the tech-innovation on a global scale.

The report recorded as many as 3,524 patent last year, by Huawei, followed by other industry giants viz. Samsung, LG, United Technologies and Siemens in the top five. Two thirds of Huawei's applications were in the field of digital communications, which includes the next generation of wireless communications know as 5G and AI. Adding to the insights, the top 10 comprises four companies from Asia; four from Europe and two from the US.

Huawei's rise to the top is hinged on the company's huge investment in R&D, which is reflected in the number of patent applications. In 2019, Huawei is estimated to have invested more than 15 billion Euro in R&D. Huawei keeps investing 10%-15% of its annual revenue in R&D. Huawei's 10-year investment in R&D is around 73 billion US dollars. The Munich-based EPO put a notable technological rise down to the developments of 5G internet and artificial intelligence (AI). These figures revealed digital communication patents went up by 19.6%, overtaking medical technology, grabbing the top spot for the field with the most innovation.

Huawei also has been in the forefront of many innovations, first one to introduce features like reverse wireless charging, on-board AI, advanced camera; popularized the triple rear camera setup and then moving up to four and also upgraded the telephoto lens to a periscope lens on the back which is capable of zooming up to 50x; Huawei is the first brand to have 7nm Dual Neural Processor Unit (NPU) chipset. It is the worlds first chipset in the size clocking at 2.8GHz, as well as supporting LTE Cat.19 connectivity allowing download speeds up to 1.6Gbps. Also made gradient colour design mainstream.

Huawei enjoys a considerable advantage in patents, which is considered as crucial intellectual ammunition in international competition. Over the past few decades, Huawei has accumulated a leading number of overseas patents.

By 2015, Huawei Consumer BG had more than 9000 global patent applications, including more than 2000 patents obtained in China and 1100 in overseas areas like Europe, America and other regions. Huawei's top priority is R&D investment and cutting edge innovation, which results in glowing reviews of the products line up across the world.

The European Patent Office (EPO) has released a patent ranking for 2019. The data released reveals that the office received a total of over 181,000 patent applications in 2019. The figure represented an increase of 4% over 2018. This list is head by Huawei and followed by Samsung and LG. China is leading with The United States, Germany, and Japan making up to the top three.
