120 Startups get Patents via Expedited Examination; Women Innovators to Get Quick Approvals

Ramesh Abhishek, Secretary, Department for Promotion of Industry and Internal Trade (DPIIT, formerly known as DIPP) that 120 startups have been granted patents under the expedited examination process for applications since it was introduced.

The Indian Government, through DPIIT, has taken up various initiatives to reduce the time for examination of intellectual property rights (IPR) applications. In May 2016, two of the most noteworthy initiatives are appointment of a large number of patent examiners and introduction of an option to expedite examination of patent applications.

Startups that meet the stated criteria can avail the expedited examination facility by paying stipulated fees, which ranges from INR 2500 for small startups to INR 12,500 for large companies.

Speaking at CII’s India Intellectual Property Convention held in New Delhi on Friday, Abhishek said that the time for the first examination of trademarks applications has been reduced to about one month from 13 months earlier.

“We are using technology and artificial intelligence for the examination of IP applications,” Abhishek added.

Patents By Female Innovators

DPITT has floated a draft rule to amend the Patents Rules, 2003 under which a patent application filed by a female innovator will be examined expeditiously with a view to promoting women entrepreneurship in the country.

According to the draft rules, if the applicant or at least one of the applicants in a group seeking patent is a female, that application would get an expedited examination by the Indian Patent Office.

Last month, World Intellectual Property Organization (WIPO) had released a report according to which India has marked the highest growth among the top 15 nations with 27% growth.

Expedited examination procedure

The primary advantage of expedited examination is that, the applications for which expedited examination is requested will be allotted to a queue, which is different from the ordinary examination queue, which already has lakhs of applications awaiting examination.

The applications for which expedited examination is requested will be allotted to an examiner for examination substantially sooner than the applications that have been queued for ordinary examination. Once the application queued for expedited examination is allotted to an examiner, the procedure to be followed is time bound, and the same is illustrated in the flow chart below.
